What warranty conditions apply to purchases from the VARIBOX webshop?

The VARIBOX webshop is exclusively intended for business customers (B2B). Products are not sold to consumers through the VARIBOX webshop.

Products available through the VARIBOX webshop are sold by different Rotovia legal entities depending on the VARIBOX product range concerned.

Rotovia Deventer B.V. is the seller of:

  • VARIBOX Full Containment (FC) and related parts;
  • VARIBOX Compact Containment (CC) and related parts; and
  • VARIBOX Drumtainer and related parts.

Purchases of these products are subject to the General Conditions of Sale of Rotovia Deventer B.V.

Rotovia Montoir SAS is the seller of:

  • VARIBOX Single Containment (SC) and related parts.

Purchases of these products are subject to the General Conditions of Sale applicable to Rotovia Montoir SAS.

The applicable seller and Conditions of Sale are therefore determined by the product purchased.

These Warranty Conditions provide additional product-specific information regarding warranty, shelf life, lifetime, storage, installation and use of products and components purchased through the VARIBOX webshop.

These Warranty Conditions do not replace, extend or amend the applicable Conditions of Sale. In the event of any inconsistency, the Conditions of Sale applicable to the relevant seller and purchase shall prevail.

Warranty, shelf life and lifetime

Warranty, shelf life and lifetime are separate concepts.

Warranty refers to the contractual rights and remedies available in the event of a defect or non-conformity for which the relevant Rotovia seller is responsible. Warranty rights, claim requirements and available remedies are governed by the Conditions of Sale applicable to the seller of the relevant product.

Shelf life refers to the period during which an unused component can reasonably be expected to remain suitable for application when stored under the prescribed conditions.

Lifetime refers to the period during which a component can reasonably be expected to remain suitable after it has been fitted in/on a VARIBOX or is otherwise in use.

Shelf life and lifetime are expected product-life periods and are not warranty periods. They do not constitute a guaranteed minimum service life and do not replace, extend or modify the warranty provisions contained in the applicable Conditions of Sale.

Shelf life and lifetime of VARIBOX components

The following shelf life and lifetime guidance applies to:

  • VARIBOX Safeline Performance extractor tubes
  • VARIBOX Safeline Precision extractor tubes
  • VARIBOX Safeline Food extractor tubes
  • VARIBOX Safeline counter couplers
  • NS4 extractor tube
  • CDS extractor tubes
  • Overpressure vents
  • VARIBOX Screwcaps
  • Level sensors
  • Counter connectors

Provided that these products are transported, stored, applied and handled responsibly and in accordance with their intended use, Rotovia estimates the following expected periods.

Shelf life – before application: up to 24 months

The expected shelf life of the above VARIBOX components before application is up to 24 months.

This assumes that the components remain unused and are stored in their original packaging in a dry place without extreme temperature variations or other adverse environmental conditions.

In practice, shelf life may exceed the indicated period. However, improper storage, transportation or handling, as well as humid, tropical or other adverse storage conditions, may shorten the shelf life of the components.

Lifetime – fitted in/on a VARIBOX or in use: up to 12 months

Once one of the above components has been fitted in/on a VARIBOX or is otherwise in use, its expected lifetime is up to 12 months.

The actual lifetime depends on the selected product, application and operating conditions. Under typical conditions, the lifetime may exceed 12 months. However, improper handling, intensive use, exposure to highly corrosive substances or harsh environmental conditions may significantly shorten the lifetime.

The stated 12-month lifetime is an indicative expected product lifetime. It is not a guaranteed minimum lifetime or warranty period.

What factors can affect shelf life and lifetime?

The actual shelf life and lifetime of VARIBOX components depend on circumstances that are partly outside Rotovia’s control.

These include, but are not limited to:

  • transportation and handling;
  • storage conditions;
  • correct product selection;
  • correct installation and assembly;
  • filling and emptying processes;
  • frequency and intensity of use;
  • temperature and environmental conditions;
  • the filling product and its chemical properties;
  • chemical exposure and compatibility;
  • normal wear and tear;
  • maintenance; and
  • compliance with applicable product instructions.

As a result, the actual shelf life or lifetime of a component may be shorter or longer than the indicated period.

Chemical compatibility and product selection

Some VARIBOX components come into direct or indirect contact with chemical products during use.

Depending on the chemical substance, concentration, temperature, exposure time and operating conditions, chemical contact may result in corrosion, swelling, degradation or other deterioration of a component. This may significantly reduce its lifetime.

The business customer is responsible for selecting a product or component that is suitable for its intended application, filling product and operating conditions.

Where there is uncertainty regarding chemical compatibility or product selection, Rotovia should be contacted before ordering, installing or using the product or component.

Information or advice provided by Rotovia does not relieve the customer of its responsibility to determine whether a product is suitable for its intended application, except where expressly agreed otherwise in writing.

Correct installation and use of spare parts

VARIBOX components and spare parts must be selected, assembled, installed, commissioned, maintained and used correctly and in accordance with their intended purpose and the applicable VARIBOX instructions, manuals and safety information.

Incorrect assembly, installation or use may damage the component, the VARIBOX or other equipment.

Damage or problems resulting from incorrect selection, assembly, installation or use, improper handling, abuse, modifications to components or unauthorised repairs do not create additional warranty rights beyond those provided under the applicable Conditions of Sale.

Normal wear and tear

VARIBOX components may be subject to mechanical stress, chemical exposure and other operational influences during normal use.

Normal wear and tear, ageing, chemical degradation and deterioration resulting from normal or expected use must therefore be distinguished from a material or manufacturing defect or other non-conformity for which the relevant Rotovia seller is responsible.

Reaching the end of a component’s expected lifetime does not in itself constitute a defect.

Similarly, failure of a component before the indicated expected lifetime has been reached does not automatically constitute a warranty defect. Each claim must be assessed based on its circumstances and in accordance with the Conditions of Sale applicable to the relevant purchase.

Inspection and notification of defects

As a business customer, you are responsible for inspecting products upon receipt.

Any shortage, visible damage, defect, incorrect product or other non-conformity must be reported in accordance with the notification periods and procedures specified in the Conditions of Sale applicable to the relevant seller.

Different notification periods and procedures may apply depending on whether the product was sold by Rotovia Deventer B.V. or Rotovia Montoir SAS.

Defects that could not reasonably have been identified during the initial inspection should be reported as soon as they are discovered, subject to the applicable Conditions of Sale.

Failure to inspect products or report a defect within the applicable period may affect your rights.

How do I make a warranty claim?

If you believe that a product purchased through the VARIBOX webshop is defective or non-conforming, please contact Rotovia as soon as possible.

To enable us to investigate the claim, please provide, where applicable:

  • webshop order number and/or invoice number;
  • product name and/or article number;
  • quantity affected;
  • date of delivery;
  • a clear description of the defect or non-conformity;
  • photographs or other evidence of the issue;
  • information regarding installation and use;
  • information regarding the filling product or chemicals involved, where relevant; and
  • any other information reasonably required to assess the claim.

The affected product should be retained and made available for inspection if requested.

Products must not be returned without following the applicable return or claim procedure.

What happens if a warranty claim is accepted?

The rights and remedies available following an accepted warranty claim depend on the seller of the relevant product.

For products sold by Rotovia Deventer B.V., the applicable warranty provisions, claim procedure, remedies and limitations of liability are governed by the General Conditions of Sale of Rotovia Deventer B.V.

For VARIBOX SC products and related parts sold by Rotovia Montoir SAS, the applicable warranty provisions, claim procedure, remedies and limitations of liability are governed by the General Conditions of Sale applicable to Rotovia Montoir SAS.

Nothing in these Warranty Conditions creates a right to repair, replacement, reimbursement, credit, compensation or any other remedy beyond the rights provided under the applicable Conditions of Sale or mandatory applicable law.

Liability

Liability relating to defective or non-conforming products and any resulting losses or damages is governed by the Conditions of Sale applicable to the seller of the relevant product.

These Warranty Conditions do not extend the liability of Rotovia Deventer B.V. or Rotovia Montoir SAS beyond the liability accepted under their respective Conditions of Sale.
